The law setting minimum time to consider a severance agreement that waives age-discrimination claims.

The Older Workers Benefit Protection Act governs waivers of age-discrimination claims by workers 40 and older. A valid waiver must give at least 21 days to consider the offer, rising to 45 days when it accompanies a group layoff or exit incentive programme, and must allow 7 days after signing during which the signature may be revoked. The EEOC states that the seven-day revocation period cannot be changed or waived by either party for any reason, and the agreement is unenforceable until it expires.
